NRAM PPI

Hi All

I entered my TD in 2008 and was subsequently discharged late in 2013 after my Trustee went after all the PPI he could, I have recently sent a letter about PPI to NRAM and they have confirmed that I am due some redress, they have also stated that they will not be giving it to me as I was in a TD, they have further stated that they will give it to the Trustee if he so wishes, I called the FSO and they have advised that if my trustee is no longer "In Office" with regard to my account then they should be sending the funds to me and they will take my case forward if NRAM do not comply.

So today I have emailed my trustee and have asked for clarification on his position regarding "In Office" and I'll see what he comes back with, has anyone had similar experiences?

Welcome to the forum moirfc.

I'm afraid we've heard that NRAM has taken the position that they can set-off PPI claims payments against any debt of yours that they previously wrote-off via your trust deed.

You may have read the same about RBS in this forum.

This position may change.

Many thanks for the response, I have been reading all morning about the RBS/Suprteme Court ruling, I have also emailed my former Trustee for clarification about him still being "In Office" but still await a relpy, I have also drafted aletter to NRAM quoting/linking the Supreme Court Ruling and advising them that I will be taking this further through the FSO. (once I receive word back from my ex Trustee of course) I was hoping to find some draft letters to these companies here that I could alter and send to other companies I previously had debts with, but I can't see any, I am aware the trustee was successful in getting some redress but from whom I do not know as he never furnished me with the information.

The "in office" issue is pretty easy moirfc.

Google the "register of insolvencies" and do a search using your own personal details.

Your details are removed one year after your trustee is discharged (is no longer in office).

If you're not on the register, your trustee will not be in office.

The Supreme Court ruling wasn't about this issue of set-off, so I'm not sure how useful it is here.

You could also put in an information request to your former trustee about the PPI claims they handled. It's your data - if they have it they should share it with you.

I did a search on the register and cannot see my name anywhere so I guess I'm ok in terms of "In Office" I think NRAM want something in writing though?
that's a good tip about the FOI request I'll do that if he's not too forthcoming.

A reply from my trustee who's not in the office today so looking positive so far...

"I am not in the office but can confirm that your trust deed was closed in 2013 and I have no interest in any ppi refund which may be due. It looks like you may have to take this to FOS. I will write to you stating that i have no interest and that I have abandoned the ppi to you once Iโ€™m back in the office."

NRAM I'm coming for you!
