Hi Clair

A creditor would need to raise court action, get decree and serve a charge for payment before being able to proceed to an arrestment.

The only one who can miss out the above and proceed much quicker would.be council, for Council Tax.

Thank you again Mark. Just one more question please. Although all the debt is in my name will this affect my husbands credit file?

Hi clair.

Credit records are individual things. Your individual credit ratings will not be affected by the actions of each other (unless you fail to pay a joint debt).

However, if you have joint financial arrangements (like a joint mortgage or a joint current account) a financial link between you will appear on your credit reports.

Some lenders may check that link and, if they found the other individual had credit problems or simply just a lot of debt, they might be less comfortable in lending to the potential borrower.
