Hi

As I am new to a Trust Deed I am so happy that I have found this forum to answer a few of my questions.

I have a phone contract which is currently £31.00 a month and included in my trust deed,

My phone is basically on its last legs and when checking my upgrade options the cheapest would be £57.00 per month for a new phone.

My question is am I allowed to get this new phone contract as it is more than what was budgeted for?

I cant see any other contracts which are the same as what I was on.

Many thanks

Hi JackieMcR.

You can take out the new contract.

It might be worth contacting your trustee to see if you payment can be adjusted in line with this.

I guess the fact is that there are contracts around costing less than £57 per month (though perhaps of course not for the type of phone unit and service that you want and/or need) so they might be reluctant to amend your payment. Nothing wrong with asking though.

This could potentially leave you needing to cut back on other things a little to accommodate the increased telephone expenditure.

Hi JackieMcR, welcome to the forum.

£57pm is more than would normally be allowed for phone expenditure, based on the guidelines that are laid down in regulations. In order for the trustee to allow that expenditure in your budget you would need to have a good justification as to why your circumstances warrant spending this amount each month.

The likely outcome might be that you have to cover the cost within the budget already agreed with them - ie cut back elsewhere in order to be able to afford it.
