Does anyone know if the new legislation that cane out in Novemeber 2010 can be used on trust deeds that started before this date? I heard that the Debtors home is safe and wouldnt be included. Would a creditor be happy to accept this as a change due to todays current climate?

Unfortunately no. Even with the new legislation there are a huge number of hoops to go through to have creditors exclude property. Plus the new stuff is designed for no or minimal equity.
