Okay meeting last week went very well with trust deed company and i am awaiting the paperwork through to sign final section, everything else got signed last week and my bills went away with him.
I have got another bank account getting finalised and have removed all funds from my present account (advise from advisor as going to start paying them straight away)
Now my loan and creditn cards are due payment 1st of month and am now stressing already about the calls I'm going to get ๐
Can I say i am in a trust deed when i am still awaiting the paperwork to sign? and what can I legally tell my creditors ???
I have gone from relief to stress in a matter of days, as I have NEVER not paid a bill and have no idea how these people will react and I am feeling more stressed the closer Wednesday gets
Hi newsm.
I can understand that this is a nervous time for you.
If you get calls tell them you're no longer in a position to make payments, that you will not make payments and that you've nothing further to say until they respond formally to the trust deed paperwork that they'll receive shortly.
If they call again tell them you've already informed them you have nothing to say until they respond formally to the trust deed, then hang up.
Newsm,
You may be surprised, I remember quite a few of my creditors actually wished me luck when I told them, if they have any probs just tell them to contact your IP thats what I did and they were fine with that.
All the Best
Thank you very much TDA and Hamish ๐
NO phone calls ๐ after I spent most of the jumping when phone rang lol and the Forms came today and have been posted back ๐ and I have had confirmation the RBS are givingme the Key account. Spoke to Aileen at the firm and the first payment is not going to be until July so can put this months payment money i had towards paying off one of my hubbys credit cards so he is happier too
Let your trustee deal with anything that comes through the post or any phonecalls you might get. It might last a month, it might last 6. You might get debt collectors trying to harrass you but try not to let it worry you. Pass it all on to your trustee, it's what they're there for. I used to send a bunch of stuff to mine once a week and they did all the calling to people to remind them the trust deed was protected and everything was to go through them now. If you feel happier, write a letter to all your creditors informing them of what's going on and refer them to the trustee. Turn the ringer on your phone on silent and get caller ID. Any numbers you don't recognise, ignore them. Let them leave messages and when you hear them, remember that in a short time you'll be debt free.
Nothing left to discharge - everything's done and dusted!
gilian who did you go with as all sounds contained and reassuring
Just had a txt from Lloyds but at work just now so can't phone them and I dont know if i have the bottle to?, I know I missed a call from them today as i phoned the number back, but it was an automated message.
I think they have tried to call the house, but left no message and I was asleep so ringer was set to silent.
I am registered in the edinburgh gazette though 5 wks of stress have started ๐
I went with Invocas. I know there have been people who've had problems with them but I've been fine. I'll see if that's the case when I get to the point of being discharged - 6 months and counting. When it came to phonecalls, letters etc, I just kept calling and forwarding things to my trustee. His assistant kept phoning and faxing but some agencies are a bit harder to convince than others. Always remember that once protected, there's nothing they can chase you for so let it all fall on deaf ears.
One of my creditors was Lloyds TSB. I think they were the one I may have owed most to, can't remember. They actually behaved better than some of mine. They didn't call or write that much and also are pretty accurate in when they registered the defaults as far as the credit ref agencies go. I know the next 5 weeks will be stressful but you've probably been through worse stress worrying about how to pay your debts and keep your head above water.
Nothing left to discharge - everything's done and dusted!
Is it safe to say due to the fact I have heard nothing from trust deed company that I am now protected? I went into the Edinburgh Gazette 7th June
And how many times will i have to tell Lloyds lol 5 times so far
You can check the status of your trust deed on the accountant in bankruptcy website, just registar and search and it should give you the date of pretection. Hope this helps.
g giles
Thanks TDA took your advice and contacted them, they are sending out the paperwork for protected status today, no-one has refused what I am able to pay either which is great news. 1 wierd thing is though that my council has put in a claim against me only I have never owed anything in rent or council tax and it's for 2002-2003 when I wasn't even at this flat so they are going to query this but say that its under ยฃ400 so it wouldnt affect anything anyway
Congratulations newsm. It's great to hear that your creditors have accepted the trust deed.
It doesn't look as though the issue with the council makes any difference to you so nothing to worry about.
Just thinking about it, it's an awful long time since we had a member report that their trust deed didn't become protected. Here's hoping that this extended run of success continues for a lot longer.
Hi all
Don't let all these firms fool you, getting the Trust Deed accepted is far easier than it was 3 or 4 years ago.
The vast majority of creditors are dealt with by 2 companies who decide if they'll accept or reject the proposal. The companies in question provide guidelines to IP's as to what is acceptable and what's not, so preparing a proposal is done using their criteria. Amy decent firm should be able to get it accepted.
Hope I'm not giving the game away!
