Hi TDA
See my previous post. I'm out.
Think we were writing our previous posts at the same time tinsoldier.
If you return to the topic, the bit I don't get is how the re-opened trust deed is scuppering a sale.
If some/most sales are still going through, even if a delay may be created sometimes, then surely the re-opened trust deed isn't itself stopping such sales taking place?
Surely it's some kind of knock-on effect for the purchaser or seller that's the eventual cause of a deal breaking down?
It's a genuine question; you have professional experience in this area and I don't.
I wrote to the AIB yesterday to ask how Trust Deeds being re-opened to ingather PPI would be recorded and processed, and if they would be notified to the Credit Reference Agencies.
No point arguing and getting anxious and upset when we do not actually have the facts we need relating to this matter.
Of course they may not know either at this point.[:D]

That's a good idea Firewalker!
Apart from that, if people are worried about their credit report, or about a property sale falling through because their TD has been re-opened, why don't they ask the trustee to give them a letter which explains that the person was discharged on whatever date and the re-opening of the TD doesn't change that fact.
If the trustee refuses to give them a letter like that, complain.
Also, when they go to court they can tell the Sheriff that the trustee refused to confirm that the re-opening of the TD won't affect the person's credit report or ability to sell their house.
I have a pre proof hearing on the 1st June re my trustee to reopen my trust deed. I was asked by the Sheriff to submit my answers to the application to the court by the 5th May which a solicitor has done for me. I am incidentally still continuing to represent myself. I received a letter from his solicitor today making reference to a case with a Sheriff Hooligan where he ruled that the application for reappointment was not incompetent. I do not understand legal jargon and I will indeed continue to fight this reappointment hoping that the Doneen case at the Inner court of session clears this up once and for all.
