Hi, can you tell me, I'm considering entering into a trust deed, if I do am I able to continue with my mobile phone account (Orange) or does this account become one of the creditors ?

Hi Stephanie

The Trust Deed will have no effect on this. It is like gas, electricity etc and will continue as normal.

Can I ask another question - I know it's all ifs and buts but if I was to enter into a trust deed and say half way through it my husband or I were made redundant, would all of the redundancy money have to be paid over or would we be able to keep some of it ? What would be the standard practice ? Thanks

Hi Stephanie

Generally your Trustee can have no interest in your husbands money/assets under a Trust Deed.

If you were made redundant then the Trustee could look at the non statutory element of the payments. By that I mean if you received an additional payment, then he could look at that.

Thank you TDA, that was most helpful and reassuring. It's such a worrying time, so many ifs and buts - it's hard to know what to do but seeing an end in sight is the most attractive prospect of all, thank you.
