Hi
I'm currently in the process of discussing that my trust deed with my insolvency agency was missold due to me not being given all clear options and being misinformed of a number of the features. The insolvency agency aren't being very forth coming with help and have taken away the information to investigate.
What would happen if after 2years and 6months it was agreed my trust deed was missold. Would everything be reverted back to what it was before I became protected? What would happen the monies I have been paid?
I'm not sure that the Trust Deed can simply be wiped off the record, Mr Dee.
How long is your trust deed supposed to run for? It would seem a shame to pay for so long and then not get the benefit of the debt write-off at the end.
Any compensation you received would be taken by your ex-trustee and distributed to creditors.
Joking. Maybe.
Hi MrDee and welcome.
This is a complicated issue because a trust deed is effectively a legal event. Parties gained legal responsibilities and obligations when it was set-up, so it's not as simple as reverting back to how it was before. What has happened has happened.
I'd be very interested to understand more about the concerns that have left you feeling this way. We might be able to help you a bit more if you're prepared to enlighten us.
TDA isn't a trust deed a wholly legal event, not effectively as you said?
Mr Dee i am currntly going through the same wiith a comany and AIB, I'd be interested to hear if you ever got a decent resolve?
