hi all,
signed td dec 2008 final payment was dec 2011.in nov 2012 my boiler packed in as i never heard from ip for nearly a year i used a ppi claim of £1600 to get new boiler.now ip has contacted me to chase up ppi,how will this affect my td.having read your forum i know its my fault just need some advice please.

In theory the Trustee could continue the Trust Deed and pursue you for the £1600. That said, you should voice concerns over why your trustee has taken 4 and a half years into a 3 year trust deed to start pursuing this and ask if creditors have received any dividend payments in that time and why it was not closed in 2011.

thanks mark,
no payments have been made to creditors yet,invocas just had my property surveyed yesterday which is fine with me.do you think i should offer to pay the £1600 in installments and would they be likely to accept that.

Unbelievable! I always thought the Trustee acted for the benefit of the creditors.

I wouldn't make any offer until the have explained why you are nearly 5 years into a 3 year Trust Deed, why they have not paid a dividend when they have been holding funds for nearly 5 years and why they are only now looking at PPI.
