Hi all, last year , I had all the hassle of my trust deed and kpmg. I satisfied my creditors, paid my fee to kpmg. Well I submitted a claim to MBNA for ppi, sent them the terms and con of my trust deed, sent them copies of my discharge, and now they tell me I'm not eligible to claim? what even though my trust deed is finished? cause they say that even though my trust deed is finished, my trustee is the one who should be claiming not me. anyone heard of this?

It says in the letter, that the trust deed pledged the right to make the complaint to the trustee and that right continues even though the trust deed has ended.

What does anyone make of this statement?

I have sent MBNA copy of my trustees discharge , and have paid what I owed in full plus 8% interest.

Hi fizzy.

If this debt was fully repaid it would appear that MBNA have nothing to set the PPI repayment against.

If your trustee has been discharged their involvement has ended.

This sounds a little bit like a standard letter that misses the point of your unique circumstances.

Unfortunately it seems as though you'll need to battle this out with MBNA, and perhaps use the Financial Ombudsman later as well.

I'm no PPI expert but it sounds as though this could eventually end well for you.

Don't give it up, fizzy - you have every right to make a claim and if they won't pay out then you can take it to the ombudsman

Hi. I had exactly the same response from MBNA even though I provided proof of my discharge and also proof the Trustee's discharge. Still trying to decide whether to pursue or not :/

A wee update, called kpmg who confirmed that they have no further interest in mt trust deed and they advised that my discharge letter should have been adequate, but I have asked if thet will draft me a letter confirming that they have no further interest. i do think that this is a standard letter just to scare people from pursuing , their just creating obstacles , so my advice to anyone in the same position is to pursue them. What have you to lose?

I will not give up I will take them to the ombusman if needed, no doubt they will maybe come up with some other reason to not pay out, il keep you informed. I did call mbna after I called kpmg and said the the very disinterested guy who was taking my call, that there information was incorrect and I am indeed entitled to claim ,told him to call kpmg to confirm, but he advised everything has to be in writing, so I will send him a copy if the letter when I get it, Mbna had a dealine of 7th October to handle my claim. Mbna letter is somewhat contradictory, in one hand it says to contact my trustee for further info and on the other hand it says this is there final letter, don't think so !
