local council and trust deeds

can a trust deed be set up with local council if the debt is made up of reclaimed wages, reclaimed car loan and council tax.

I wonder if you could provide a little more information to help us to provide some advice for you?

Regarding your wages have you been overpaid? If so could you let us know if you continue to work for the same employer?

Are you behind on a car loan? If so do you know whether the loan is secured on the car (for example it is on Hire Purchase)?

I'm presuming you have some council tax arrears? Are they recent and for your current home?

I lost my job with local council, it is a long story. Anyway my car was through a loan administered by the council and they wanted a months wages repaid. Also council tax arrears that were for a house I previously lived in with my husband. The total debt is made up of car loan, wages, and council tax. I have kept to arrangement through Scott & co of ?é?ú40.00 per month for the last year. But council now say they want ?é?ú400.00 or are going for sequestration. I cannot pay ?é?ú400.00 I am on benefits as I care for my mentally ill husband. So what do I do. Help!

I think "Scott & Co" are a debt collection company acting for your local council?

Could you let me know if your are a homeowner and, if so, whether there is any equity in your home? Also do you have any other significant assets?

You obviously have a lot to deal with at the moment. The experts and I will do all that we can to help you with this.

Thanks for your kind words. I am what you would call LILA. I live in rented house and have no assets. I am totally hacked of with the council, they know my circumstances, they have had letters from my husbands doctors which they disregard. My local MP has even writtem to them but again this was ignored. Anyway as I do volunteer work at the local CAB - I thought i would check out trust deeds through this site rather than the local CAB as I prefer to deal with this myself. I would feel more in control of things with a trust deed as opposed to council sequestrating me. But I know that this may not be possible.

looking at your circumstances, I'm not sure a Trust Deed is the correct solution. My advice would be to look at LILA sequestration.

With the above, the sequestration would be over in 12 months and with the exception of the initial ?ú100 cost, there is unlikely to be any other cost for you. If you are on benefits, then there would be no ongoing contribution. This would certainly seem to be the best option for your circumstance.

I bet you're hacked off with the council. It's more than a shame if public servants in local councils fail to take account the needs of their residents as well as the expertise of their doctors and MP's.

Benefit income is designed to cover the essential needs of the recipients. As such it would not normally be considered that a surplus of funds would exist that could be used to fund a solution such as a Scottish Trust Deed.

Another option that you might consider is LILA (low income low asset) sequestration. As you have no major assets there appears to be nothing tangible to lose.
As your income is made up of benefits it is very unlikely that you would have to make any monthly contribution towards the debts.
You would be discharged after a year (a Trust Deed would normally take three years).
The fee is a one-off around ?ú100 compared to monthly Trust Deed payments that would normally need to be a good bit higher than this for three years.
You would control the timing of the process rather than the worry associated with waiting to see what the local council do.

There is more information about LILA sequestration on the menu to the left hand side of this page. You can also read more about it at the website of the Accountant in Bankruptcy.

I think it's well worth having a think about this option as it might be more appropriate in these circumstances.
