Hi,

Today I received a letter from one of my former creditors (now covered by my Trust Deed), advising me that my personal loan has fallen into arrears as I have missed a number of contractual payments.

It goes on to say that they are obliged to send me this notice as my loan is regulated by the Consumer Credit Act. The letter also states that this is not a demand for payment, however if payment under the agreed arrangement is not received, they may send a demand notice separately.

Basically, I am wondering if this is something I need to be concerned about? My understanding is that since my trust deed is protected, my previous creditors cannot pursue me for payment.

Presumably this is something I can simply forward to my trustee and let them deal with?

Hi Ian,

These letters tend to be computer generated and I don't think you need to worry about it at all.

Your idea to forward it to your Trustee makes sense.

Trust Deed Assistant is right, just forward it on. The law changed recently so that banks have to send out updates periodically. Even though you are in a trust deed a creditor might send it out anyway but it doesn't mean that they are still chasing you and the letters should stop once you are discharged from your trust deed.
