letter threatening eviction!

Hi,

Mark helped me a few months back with my Trust Deed problems, and I really need his advice again.

My problem before was my Trust Deed company was trying to tell me that I had 13K equity in my house at time of signing. However, they told me this based on a drive by valuation 4 years after I signed the deed. When I told them that if this was the case, a remortgage would have covered my debts and so would have not needed a trust deed, he told me to organise a proper valuation myself. I contacted his office, to be told that he was on leave for approximately 3 months, and would contact me on his return. I also asked for bank details so that I could pay small amounts to them towards equity that may be decided by my own valuation, and was told that this would be sent to me in due course. This was all via telephone. The next I heard was on saturday when I got a letter saying that I had ignored the last letter from February, and if I did not contact them within 14 day they would contact solicitors to arrange eviction!

I do not know where to start in getting a valuation done based on the market in 2004, and they are more or less refusing to advise me.

Please help, I send an email to Mark but maybe have the wrong address as Ihave not had a reply

What do I ask for if I phone a surveyor? How much is this likely to cost me? and what do I do about this contact within 14 days since it was sent on the 25th October, and with this weather I can't guarantee a letter getting back to them in time. Also, whenever I email them, if it is something that benefits them they answer, if it is something i need to know they ignore it and blame me for putting the wrong address in. I can';t even get to the citizens advice bureau as I have been snowed in for 4 days and there is no way I am getting out in the near future

Hello kerry,

I've sent an email to Mark asking him to review this thread as soon as he gets the chance. Obviously he's out on the road a lot visiting clients but I'm sure he will check into the forum soon.

Our other experts may have thoughts as well if they visit the forum before Mark does.

Hi Kerry

It sounds like whoever you spoke to at your trustee's firm has not noted this on your file, so another letter has come out to you on the assumption that you are not cooperating with them.

It is easy for me to say, but try not to worry too much about the letter you received - my bet is that they send this out as a matter of course to try and push people towards complying, but it doesn't mean that you are about to be evicted. Besides, they have to go through a costly legal action first, which they will undoubtedly wish to avoid if possible.

Keep records of any correspondence you have with your trustee, just in case they come in handy if the threat of eviction does progress further.

You would contact a surveyor and ask for a retrospective valuation. The cost is likely to be ?ú150 - ?ú200 I imagine - though to my mind your trustee should be organising this and paying for it as an outlay connected with your trust deed.
