I am 1 year into my trust deed, I have an insurance policy that has matured & has been sent to kpmg to cover my debt, I am having problems getting them to wind up my trust deed.

They have made me wait 10 weeks , then another 2 weeks incase my debtors appeal, that time has now passed & now they are telling me it will take another 3 - 4 months. No-one responds to your calls, they never send any information out re timescale, I will be sending a letter of complaint to them. Does anybody know of the legal time- scale for winding up trust deeds when there is more than enough money to cover what i owe?

Welcome to the trust deed forum fizzy.

I'm not aware of any legal timescale for this to take place.

Because of that we can only really suggest that you continue to (quite reasonably) request that this is progressed as quickly as possible.

From what you have written it would appear that there is no need for things to take as long as suggested, but of course we don't know whether there are any special circumstances relevant to your case.

It should be a simple enough process to issue you with your discharge (form 5) and then to tie up all other loose ends themselves afterwards before they seek their own discharge.

Were your debts covered plus interest and the trustee's fees, fizzy?

Hi Kevin & TDA, I am very frustrated, there is enough money to cover all monies owed, my debt was 13k , kpmg have received a cheque for ยฃ24,000 more than enough to cover all of the debt , interest & fees. they told me by law there has to be a 10 week period for my debtors to lodge their claim., fair enough, I was told the cut off date was 27th July, I called back after this time and was told my debtors had a further 2 weeks to lodge an appeal, fair enough I waited another 2 weeks. I called back today and was told they will have to send out letters to all my debtors ( just 4 companies mostly credit cards) to advise them what their fees are. I do not understand why they have to do this, as it it me who is paying their fees, and the girl woth the monotone voice said it will be another 3-4 months . there are no special circumstances it's pretty straight forward. I have asked to speak to the supervisor re timescales. Intend to letter them as well. their service seemed to be really attentive when I took out the TD , phone calls, emails text mesg, now I do,nt even get a response. I have every day this week, asking for someone to call me back & they never do. I'm so fed up with it all. I
my four year old daughter passed away last month & I had to borrow money to cover the funeral costs, kpmg advised they could give me an interim payment, I don't want an interim payment I want settled in full

I'm really sorry to hear about your daughter.

On the issue of the discharge from your trust deed, I wish we could offer some practical help that would help you to get this progressed.

The unfortunate reality, that we've heard many times on the forum, is that some firms seem to get this done quicker than others. There are some firms that appear not to understand (or possibly not to care) just how important some of their clients consider this to be

hi TDA, thank you for your response, I must admit I am at breaking point with KPMG, they don't seem to be very compassionate, I think I'm just a number. do you know the address of the trust deed regulator, as I want to copy them in on my letter. believe u me I don't really want to be battling with them just now, but they don't seem to care. They have a very cavalier way of dealing with their clients. I just want to bring my TD to a conclusion @ pay back what I owe. can u think of any financial reason ie upping their fees if they drag this out some more, or are they just collecting interest on the cheque they got for ยฃ24k in July?

Hi fizzy.

I really don't think there is any financial benefit to your trustee from a delay.

If you feel a complaint is warranted it should first go directly to your individual trustee. Professional bodies are only likely to take an interest if that step fails.

I only want to include the proffessional bodies in order for them to follow the progress of my complaint, as i have lost faith in KPMG, no matter what they tell me on the phone, i know that in my expereince with them, they dont log all calls and what is said, and I want to know that they are following procedure and not dragging things out just for the hell of it. Someone should know when they are not following the protocall and I dont think they are.

I think the issue is that, in terms of how long the closure process takes, that there isn't really a protocol. Different firms assign the process different levels of priority according to what we read here.

I'm not defending that, just describing what we have learned here from shared experience over the years.

I think the reasonable length of time has passed, I don't think that companies should be allowed to drag things out for 6 months, . how long does ur company take to wrap things up on a straight forward TD with only 4 debtors, or don't u want to commit

I'm a humble debt adviser working in the site advice team.

Our representatives from four trust deed firms (Mark, Kevin, Shona and Chris) tell us this is usually a straightforward process taking days/weeks rather than months for the cases that they handle.

Hi Fizzy,

I am so sorry to hear about the loss of your daughter, my heart goes out to you.

All the more reason why your trustee should be prioritising your case as I am sure battling with them is the last thing you are needing right now.

I cannot see any reason why you couldn't be discharged within a few days if they wanted to make it happen. The whole thing about agreeing fees etc is what your trustee has to do before HIS discharge, but your discharge is something different and you ahould be discharged (Form 5) as soon as you have met your obligations (ie paid the money across).

I think you might have to speak to them again and if you still don't get a satisfactory answer as to why they cannot do this then ask to speak to someone more senior.
