4 years ago I divorced my husband. It was amicable, we dealt with things through a Notary Public rather than expensive lawyers. He wanted to be house husband and my career was taking off when our son was born. I work in the health service in Edinburgh 3 days a week, so I allowed him to keep the house as I could stay with my sister and he had nowhere else to go. The mortgage still had 12 years to go when we divorced and the agreement was that he would pay the remainder of the mortgage, and also he would pay me a set sum once a month for 2 years rather than me forcing the sale for my half of the house, my name would have to remain on the house deeds for the 2 years, after that he fills forms in, I sign them and then the house belongs to him.
This all worked fine, he paid me faithfully right to the end, however by this time I have re married and myself and new husband wish to take out a mortgage for our own home.
I get in touch with him to request the forms and he laughs at me and tells me that I will have to wait another 2 years as he took a trust deed out 2 years ago and it lasts 4 years and this deed includes the house my name is on!!!
I don't know what to do, I feel my hands are tied, do the companies dealing with debtors not check there are no other people attached to any of these debts???

Have you approached a mortgage lender or a broker about getting a mortgage for a new house, kmcdonald? Depending upon your circumstances, there shouldn't necessarily be a problem.
Is the former marital home in negative equity?
