Hi I was told that trust deed is the less severe form of insolvency and it doesn't come under bankruptcy and if I am asked in any form that have you ever been declared bankrupt you should say no.also I was told that your name is entered in the insolvency register to which general dont have access but companies only.i wanted to ask that inside that register is it clearly written that he is in trust deed and its not bankruptcy or no?because the home office asks in visa application that have you ever been declared bankrupt so you say no to them but if they access this register will they be able to see insolvent only or trust deed too?
Hi ibmstyle.
A trust deed is not bankruptcy. Both are forms of personal insolvency. Is a trust deed less severe? Lots of people think so (but for many people, depending upon circumstances, bankruptcy might be a better option).
Anyone (an individual or company for example) can access the insolvency register. This register states whether you're in a protected trust deed or sequestration (bankruptcy) specifically.
Thanks for your reply.by less severe i meant its not bankruptcy but a form of insolvency where you make regular payments and I think it's the Edinburgh gazette which general public cant access.how can I access the insolvency register to check my details.is there an online website for it or what?
Go to the Accountant in Bankruptcy website and look for the link to the Register of Insolvencies. There's a link towards the top-right of the homepage.
The Edinburgh Gazette entries can be viewed by anyone online.
Its less severe but in my opinion only just but you are correct,if a form asks if you have ever been declared bankrupt and you have only been in a trust deed you can truthfully answer no.
