Injury Claim with Trust Deed

Hi,

Just a quick question about this, was in a car accident which wrote off the car and was taken to hospital. From this accident I've been getting physio for my injuries.

An injury claim is getting pushed forward for myself but i'm currently in a trust deed. I'm finishing my 4 year term in April if not May or June but I have overpayments to be made past this 4 years since I've had extra income (overtime).

I know that the injury claim money will need to go towards my trust deed, but will it go to my overpayments that I need to make or is it just added to the grand total (if that makes sense)

Also, do you know if I get the money first and then need to send the money to the trust deed or do they just get it?

My personal injury claim has delayed my own discharge and by the time it's sorted my TD will fall off my credit report not long after, but my claims solicitor agreed 70/30 split of monies with the trustee, so technically not all of the claim will go to the trustee.

The funds you receive from your claim may well go directly to the Trustee, 13David - I'd be surprised if they didn't contact the other solicitors/insurers involved to request that this happens. Having said that, you may be able to make a case for receiving some of those funds back from your Trustee, especially if you have incurred additional costs or lost out on some income due to your injuries.

The money from your claim is separate from any income contributions you are being asked to make due to overtime, so would be additional I'm afraid. Though if you are able to successfully make the case to your Trustee that you should be allowed to retain some of the injury claim then I guess it could be used to settle the outstanding income contributions instead.
