Wonder if someone could please clarify this - I know it was a recent topic of discussion.
My uncle passed away in July 2015. I am due an inheritance and was discharged in August 2014, but my Trustee hasn't discharge themselves.
Do I need to inform my Trustee of this?
From reading the other post I don't think I do and I get to keep the full inheritance amount? Thanks and apologies for appearing slightly stupid!
Hello Neverendingstory,
I don't think there's any issue here - you were discharged prior to any inheritance becoming due to you.
The difficulty might have been if your uncle had passed away prior to your own discharge. If the inheritance had become due to you (even if it had not yet been paid) prior to your discharge then your creditors might have stood to benefit from this "windfall".
Thank you TDA for your very prompt response!
Phew!
Hi Neverendingstory
TDA is correct. The key date to this is your discharge as the Trustee's interest in any future 'assets'ceases at this point.

Hi Neverendingstory,
Sorry to hear about your uncle passing away.
Like TDA and Mark have already advised the relevant part is your discharge.
Situations like this show the importance of being discharged promptly after completing all of your obligations. If your discharge had been delayed there could have been the possibility that the Trustee could have claimed your entitlement to the inheritance.

Thank you David. I am so glad that I was discharged promptly.
It is quite a sizeable sum so am looking at purchasing a house, but shall wait until my Trustee is discharged.
That's a sensible approach you are taking for the money.
I guess the only hurdle could be securing a mortgage (if you require one) if your credit rating isn't the best but it's a sizable amount I would think this will go in your favour.
If you do purchase a house please let us know how you get on securing a mortgage.

I am very fortunate to be in the situation that I do not think I will need a mortgage but if I do, I shall let you know how I get on.
