I was made redundant and received statutory payments. I believe I have a case for unfair dismissal. If I took this to tribunal and won my case what would happen to any payment received. I'm still unemployed and living (trying to) on benefits.

Hi saabrina.

Probably best to wait to see what one of our experts has to say, but I suspect any sum of money received would be treated in the same way as any other windfall I'm afraid.

That's a tricky one, saabrina, but I think Trust Deed Assistant is correct - the trustee may well have to request that the funds be paid in for the benefit of creditors

Thank you both for replying. I have a solicitor willing to take the case on a no win no fee basis, however, I would have to pay them £350-£450 in barrister fees prior to the hearing. I don't have that kind of money and if I did wouldn't be prepared to fork it out if I wouldn't see anything of any win. Thanks again, helped me decide.
