Any one had experience of having to claim against your Trustee's Insurance due to a badly run Trust deed and how do you go about it if things are found to not have been run as they should ?.

I am hopeful his regulatory body will find in my favour , but my complaint has been going on for 5 months now !! .

I think it is more a case of your trustee having to claim against their own insurance if a decision is made against them.

Hi Pinalta, Kevin is correct you cannot claim against their insurance, they will be able to make a claim if they are found to be "at fault" so to speak.

So if the IPA find he is at fault , and I have suffered loss due to his actions and blatant stalling tactics to claim more fees who decides what has to be paid ??. He is trying to over turn the AIB ruling about reducing his fees but has not yet launched an appeal after 4 months !! . I have asked the AIB to audit his accounts since 2006 .

He will I am sure be sending another fee circular within the next month , as he has done nothing since the last one I can not understand how fees are justified . That in turn will be another set of fees to be audited , and yet more delay .

From looking at the AIB stats about this Trustee/ firm the gravy train is alive and well , seems some Trustees fall of the radar when it comes to being regulated , so many active trust deeds over the 3 year period with some going on after 10 year , mine has been 8 years !! .

I hope the AIB grows a pair when he decides to go to court , in regard to the IPA we will see , but do not have much faith in them so far .

The regulatory bodies have very significant powers pinalta.

It's not uncommon to hear of an IP losing their licence when serious malpractice is identified for example.
