I am currently in a trust deed, my husband is not. We are behind on mortgage etc and need some money to clear some things, my husband was going to take a small loan or borrow money from family to pay arrears on mortgage etc-how would this work with me being in a trust deed?

Thanks

I thought you were advertising your hubby for loan!!

It's up to hubby if he borrows, your trust deed may be reflected on his credit rating if you have any financial links.

Do you think your trust deed payment is set too high or are there other reasons you are struggling with paying the mortgage?

No I can afford my trust deed it is more that our mortgage has been in arrears for ages etc and are asking us to pay a chunk to stop further action. So if his family lend him money to pay this, are my td fine with this? Thanks

Best to just keep them informed. Are you expected to release your share of equity at the end of the trust deed?

I will do Paul. Share of equity...I have no idea what that means? Thanks

I assumed the mortgage is joint? Any equity in the property is likely to be wanted by creditors(or at least your share of it, if the mortgage is joint of course).

I'm pretty sure when I began my trust deed they determined there was no equity in my house, but will double check this. Thanks again.

Make sure you have something in writing regarding equity as its not unusual for companies to expect a home to be valued near the end of a trust deed if it's not sorted out early on.

Hi Td14.

Your husband can borrow money if he wishes.

It's worth checking the situation regarding equity. Paying a lump sum to the mortgage lender could create equity if there isn't any now, or increase the equity if there is some already.

Thank you tda. As far as I'm aware when we signed our trust deed it was deemed there was no equity as our house is worth less than our mortgage but I will double check this. Thanks again.
