Hi,

I'm a year into a Trust Deed. (a very quick year!) I was told at the time of signing by the accountancy firm that as a matter of course they always notify HMRC when a client has entered a Trust Deed. I thought at the time this was helpful as I had a few hundred owing to HMRC from a previous small self-employed job. (but I hadn't originally listed this as a debt owing as I didn't know that you could do that)

However I phoned HMRC this week to discuss self-employed matters and to check on what I currently owe for January. They told me they have no note of me entering a Trust Deed in Sept 2011 and no-one from the accountants handling this have been in touch with them.

I just wanted to check. Is it standard procedure that HMRC should be notified? I haven't assumed that I will be paying less tax but I wanted to know should I still be paying any previous debts owing to HMRC or should they automatically be included in the creditors pot?

Hi DontDoDebt.

Don't underestimate the ability of different HMRC departments to fail to communicate with each other!

Tax debts that existed when you signed your trust deed should be included. Hopefully your trustee can get that all straightened out for you if you bring them up to date.

As long as your trustee has been sending documentation of your trustdeed to the HMRC Insolvency Claims Handling Unit Newcastle(ICHU) along with your N.I number you will be fine.

Check your creditors Claim Summary from your IP.
