I am gutted, Phoned Insolvency Practitioner today to ask if HMRC had sorted out the Dividend. This has been ongoing since last October they still haven,t heard a thing from HMRC. I am now in my 6th year of the PTD and so down, when am I ever going to get Discharged. The lad said that all Insolvency Practices are experiencing this, but can,t they just Discharge you and then settle the rest when they receive the Dividend from HMRC.

The answer is actually quite simple. Recorded Delivery letter from Trustee to HMRC advising that they have 14 days to submit their claim plus supporting documentation. If not received in the time period, the claim will be rejected.

This allows the Trustee to finalise the case.

Hi Mark,

Isn't this about the wider issue of VAT no longer being chargeable on trust deeds rather than specifically about a HMRC claim in a trust deed?

Maybe I'm misunderstanding.

You could be correct. If it's the Paymex VAT issue, then its more difficult to close pre April 2008 cases.

Hi lissybladey.

I can totally understand your frustration.

Unfortunately it is much trickier to discharge people where some matters are still incomplete for cases started prior to April 2008 (as Mark has mentioned).

That's not your fault of course, and I hope your discharge follows soon.
