HELP .... STILL NOT DISCHARGED AFTER 1 YEAR

Hi. I need some advise, I made all payments into my trust deed back in November 2011 and received the confirmation letter from begbies Traynor January 2012 confirming this

YOUR PROTECTED TRUST DEED

I write with reference to your recent telephone conversation with Corinne Carrie of this office and can confirm your final contribution to your Trust Deed has been paid.

As discussed legislation has come in stating that VAT is no longer chargeable to Trust Deed, therefore all VAT that has been charged to your case must be refunded for the benefit of your creditors. I will then proceed to close your Trust Deed and you will receive your letter of discharge in due course.

I have received a further letter dated November 2012 advising their costs between October 2011-October 2012 the letter states the same my "contributions have all been paid" however the letter continues to say "however the case will remain open until investigations into unrealised assets are complete"

I have no Assets, I do not own a car, nor do i own my house. I am a tenant with the local council authority

The letter goes onto say "however, there are insufficient funds in this case present to cover the whole fee and i ask that i may take the due balance as and when funds become available. I would also advise that th ebulk of my costs were incurred during the initial stages of the trust deed. I would hope to keep my future costs to a minimum. I would advise my fee payable in this case has varied from the estimate made in my previous statement for the following reason.

TRUST DEED WILL BE EXTENDED UNTIL INVESTIGATIONS INTO UNREALISED ASSETS ARE COMPLETE

I would advise my revised estimate fee payable in this case is now ยฃ5536.40, giving a revised estimated dividend of 0.77p/ยฃ. Should additional funds become available my fees will increase accordingly.

Creditors have the right to insist that my accounts be referred for audit to the Accountant in Bankruptcy, and my remuneration taxed by her. If you wish this procedure to be instigated. I should be grateful if you would contact me within 14 days from the date of this letter. I would advise that unless I receive any written objections from creditors within this period. I shall record approval of my fees.

Now here is were i need your help.. I have made all payments *although my contributions were lowered due to circumstances. Begbies Traynor were kept fully advised of my payments during the Trust Deed... I am now fearing the worst when i read TRUST DEED WILL BE EXTENDED UNTIL INVESTIGATIONS INTO UNREALISED ASSETS ARE COMPLETE.

What are Begbies Traynors up to ??? Why have i not received my discharge letter ??
although i have asked for it.

I would really appreciate your help as things have improved for me financially thanks to my new job that i start tomorrow. My wife & I have seen a house we want to buy and will attempt to buy it with a mortgage..

But there is no way i will make any further payments into a Trust Deed that as far as myself and Begbie Traynors have confirmed that ALL PAYMENTS WERE MADE.

Hello upnorth76.

I don't think you've been asked to make any extra payments have you?

It looks like your trustee is telling you and your creditors that they need time to deal with the VAT issue and to investigate assets.

Has there been any communication about PPI claims?

Thanks for getting back to me.. Begbies have not asked any more money.

There was a PPI claim back in 2011 which they appointed there authorised agents "james cargill" to look into on my/trustee behalf.. It turned out approx ยฃ1200 in PPI was returned and put to the trust deed - all going through "James Cargill"

How will all this effect my ability in obtaining a mortgage if its an on going saga... I have an appointment with financial advisor tomorrow.

Hi upnorth76.

Getting a mortgage is probably not going to be possible if you haven't been discharged, but see what the mortgage adviser has to say on that subject.

I think you need to ask your trustee specifically what the delay is and when they think it will be sorted out.

Glad trustees benefit from delays by charging some extra fees albeit from contributions already paid.

Extra fees that may not get paid it would seem, at least in part.

Much less benefit if that's the case.
