Delighted to announce that April was final payment to my trust deed... Form 5 received mid May which was a huge weight off my shoulders... Best thing I ever did and my thanks go to Kevin who initiated the trust deed.
I'm now on the case to clear up my credit file... I need some help and advice regarding a joint northern rock loan.. It appears my wife is liable for the total amount left over Northern rock have sold the loan on to someone else and they have now sold the debt on again to 'watch portfolio management'I have emailed them as the figures they claim are due don't add up. I've asked for original credit agreement and proof of payments however they are struggling to provide these( in their own words)
Can anyone advise what I should do! We are in year 9 of the 10 year loan and it has suggested they may not have the original docs as they only have to keep docs for 7 years due to data protection. The loan isn't showing on the credit register which I thought was odd.
Has anyone on the forum had similar experience?
If they cannot prove the debt exists can can I simply not pay it? Is there any legal processes I can put in place to insure no claim against us?
Any help very much appreciated!! This is the final bump in our financial journey I would love to iron out!!

So your wife hasn't taken any steps as yet to address her financial situation?
Has she been making any payments towards this debt?
Congratulations on reaching the end of your Trust Deed, funkie1 - I'm glad that I could contribute to you getting to this point.
I don't see how the debt could be enforced if there is no evidence of your wife's liability for it. They should be able to provide a copy of the CCA agreement. There is also a chance that the debt may be legally "prescribed" ie time-barred, though only if your wife has not acknowledged any liability for it or made any payment towards it in the last 5 years.
Do you think she may fall into this bracket?
Hello Kevin and tea! Thanks for your comments. Having taken further advice I have been advised to request copy of the original credit agreement. This will clearly show what and who is responsible. If this is unavailable I've been advised to go to contact the financial services ombudsman.im waiting to hear back and will keep you posted!
