I am looking for some advice regards my TD. Basically i have got myself into a mess as i always do. i have got a problem with gambling which is one of the reasons i am in a TD. Due to this i have recently taking out payday loans. which my older brother has recently paid off for me. I also had missed mortgage payment and fallen behind with my council tax, gas, electricity etc. Recently i have been able to do overtime at work the money from this i have used to pay these bills. I know how stupid all this is. I am seeking help to stop me from any repeat. I just wondered with regards to my Trust deed as the likely outcome as to when my trustee find all this out?

I think you need to worry more about controlling the gambling than the trust deed. What help are you getting?

I have been getting councilling from the RCA Trust. My family now also have access to my bank account so I cant access money without them knowing. I know what an absolute mess i have created. i need to work out the best way to deal with it.
I am not sure about the overtime, it was said at the time i signed (18months ago) that as long as it was not regular payments then it would be ok. In total i have been paid £1000 in total overtime there will be no more payments after this month. I have used the money to catch up with the utility bills that i was owing. I am just concerned as to how my trustee will deal with this. At the time of signing i have approx £17500 owing. I am paying £200 per month for 42 months and paid £500 from a third party as there was no equity in my house. Reading through this site i can see that was a mistake.

Hi Gibby29.
The main concern of your trustee will be that you meet the terms of your trust deed.
If you're making the regular payments and complying with any reasonable requests from them there shouldn't be an issue.
I think you need to clarify with them what should happen with overtime so that you don't build up a problem for the future.
As Paul has written, breaking the gambling cycle is probably the most important thing. It's great that you have taken action in this respect.
Are you still behind on your mortgage and/or council tax?
Yes i have made all payments to the trust deed to date.
No i am uptodate with mortgage/council tax etc just now.
I will contact my trustee regards the overtime.
They say when they do a review that the basis of the review is income based as expenditure is agreed when signing the trust deed, this is fine but as an example when i signed the trust deed my gas/electricity was £90 per month this is now up to £115 so should this not be taken into account when a review is done? From reading this site alot i just dont trust the company i am with.

You can ask for reasonable Increases on expenses where you have evidence of rising costs. Bank statement showing monthly dd for gas etc. Prices have been on the up for years and your review should reflect that.
