hya can you please help me asap my hauband and i have td separate ones he got made redundant and has just recived his redundacy pay.i phoned up the td and told them to take 1500 pound of his redundacy money because i was under the impretion that they didnt take the redundcy pay. any way she sade she would call me back and let me no what the ip sade so today she sade that they would be taking all [:0]his redundacy money. my husband still is not working is she right can they do this they sade if he paide this then that would be him finished .help

Hello larrie,

The feedback from our experts on this subject, when it has come up before, has been consistent.

It has been suggested that the "statutory" element of any settlement would generally be kept by the individual.

Additional payment made as a result of beneficial contract terms or negotiation would normally be paid into the Trust Deed.

Is the payment made to your husband for statutory entitlements?

what can i do to make sure they dont get this money? my husband is still not working and he still has to pay them 100 pound a month.when he only gets 236 amonth .

Trust Deed Assistant is right, larrie. I'd say it is worth letting your trustee know that you have had advice to say that the statutory element of any redundancy money can be retained. Let us know how you get on will you? If they still won't accept your position it may be worth telling them that you intend to take it up with your trustee's professional body or with the Accountant in Bankruptcy

If you look at the bottom of a letter that you have received from your Trustee you should find details of the professional body. It may well be ICAS.

A quick web-search will then get you the phone number.

I do think it's worth setting out your concerns in writing to your Trustee to give them the opportunity to resolve the situation before complaining to the professional body.
Many visitors to the site over recent months and years have found that their Trustee reacts positively to this.
