Hi guys just an update . I heard back from my trustee there were no objections to the payment of 3'000 which is getting sent on Monday.Do I start the complaints process now or wait for form 5 I'm sure I will get my discharge quick as he can't wait to get rid of me. I feel relieved it's at an end but then I'm still so angry with this man. Thanks again

Hi debs

Best to start it now in my opinion. Glad it seems to be coming to an end

If you have recived the consent of the creditors, then they should not be in a position to hold up your discharge. I suspect this discharge may be the quickest one ever recorded!

When this is all finaslised, give me a shout and you can be a chapter in the book I'll be writing when I retire.

Hi debs.

People will take different views. I'd wait for my discharge before pushing things further.

It's a tough call.

I think I'd be inclined to be gathering evidence, and preparing the letter of complaint right now.

But not send it anywhere until I had the Form 5, and knew that it had been registered on the Register of Insolvencies.

It's possible that my letter of complaint might mention that I had been afraid to raise a complaint until my discharge had been registered - because I had completely lost any trust in my trustee, and was afraid that my raising a legitimate complaint might lead the trustee to delay the discharge.

Of course, that's based on my personal reaction to the information you have shared about your trust deed. You might have a different view.

Hi Candlewick thanks for reply You posted a couple of times on my problem which was very helpful. I will get it all sorted and ready to go as soon as the form five arrives, as Mark said I will probably have the fastest discharge ever known in a trust deed.

Hi debs

Yes, after you receive your Form 5, the Trustee requires to seek his discharge from the creditors and that discharge takes place after 14 days if there are no objections.

The Trust Deed is then finalised when the Trustee issues Form 7 which is a summary of the funds received and spent in the period of the Trust Deed.

Hi debs

Please do. I think by the end of 2013, your story and probably Pinalta's will rank as 2 of the worst experiences.
