Has a fraud been committed?

Hi folks,

Just a quick question as I have always received a quick responce when using this forum.

I was finally discharged from my Trust deed in February 2012. I have been cleaning up my credit file and I though I only had one default let from a list of 5. However, I logged on this morning to equifax and another has just beed added. It sees that EGG banking has settled my credit card then immediately sold it on to a debt collection firm called PCO. HOLDINGS which i believe is is in Amsterdam. Whats more, there is no contact details available anywhere for them??

Is this fraud. The account was settled as per trust deed and they have sold it on to another firm. The default notice that has appeared has a date of 2008 but this was the date of the EGG default. I am confused and really concered so any help would be great.

Hi lenovo.

I doubt very very much that there has been any kind of deliberate fraud.

Egg has sold massive amounts of debt in recent times. I think your debt has probably been sold as a result of an administrative error whereby the debt hasn't been updated and removed upon the completion of your trust deed.

Is the default date consistent with the start of your trust deed?

The default date is out by a few months but I can cope with that. My problem is that this new company appears to be piggy backing on the default notice from EGG without issuing a default notice of there own. I also cant find any email/telephone information for this company at all.

Any ideas?

Any default notice would usually just be from the original lender lenovo.

I don't think you need to worry about this. The debt seller and purchaser may have entered into a transaction between themselves, but it's irrelevant to you as the debt no longer exists.

My only concern is that I will shortly be applying for a credit card to start building up me credit file and I would like all the default notices to show as settled. I thought that if I applied before this then I would definately be turned down.

It may not help lenovo.

As Egg issued the default notice my understanding is that you'll need to approach them to clear up the error on your credit report.

They should be able to do that pretty quickly for you.

Thanks TD Assistant - the default notice isseued by EGG is showing as satisfied though. Its the one from this new company thats the problem.

So the new company have issued a default notice lenovo? I may have misunderstood you on that.

When a debt is sold the seller and the purchaser are meant to write to you with the details. Have you received anything? Could Egg give you the purchaser details now? Maybe Egg and the purchaser wrote to your trustee and they could tell you the contact details for the purchaser?

Hi, I have received nothing to date in the post. I have raised a concern with Equifax as I believe by law that only one default notice can be isseued for the same debt.

Unfortunately I dont have the accound details for egg anymore as I shredded everything when I entered the TD. Lesson learned though that I should have kept a copy of at least the account details.

Could you get the details from your trustee lenovo?

Presumably they'll have kept a record.
