Harrassment Calls From First Plus

Been in a trust deed for three years and in the process of being discharged. The last fortnight First Plus have been phoning daily saying that we are in arrears. Explained that we are in a trust deed but they are saying it doesn't matter, a trust deed doesn't cover it as its a Scottish thing! Have tried explaining to them that they are wrong but they are having none of it. Have contacted KPMG and they said it would be sorted out but we are still being contacted. We have been trying hard over the years to increase our credit rating but are wondering if this will affect it. Is there anything we can do please?

Hello diaryroom and welcome to the forum.

Was the First Plus loan originally secured upon a property?

Is it still secured against a property?

Did the debt that is being chased exist at the time that your trust deed began?

Hi there
The loan was secured on a house which was then repossessed. The debt did exist at the time the trust deed began

First Plus should not be chasing you for repayment and, as you say, the person you spoke to is just plain wrong about it not applying to them.

Hopefully KPMG will get it sorted out for you. First Plus have a duty to update the debt status on your credit file accordingly once your trust deed is successfully completed and can be brought to book if they don't.

Thank you. The loan was taken out by my partners ex who then did a runner with the money. She forged his signature but despite legal advice, it couldn't be proven . The amount of the loan was 50k. The amount first plus are asking for is 25k. I think the arrears are from her half but because they don't know where she is, we are getting the calls and the black mark on our credit rating. Is there a template letter that can be sent please. Thanks again for your help

I'm going through something similar with Webb Resolutions chasing me for arrears on a loan that was secured on a house that was repossessed. It was a joint loan with my ex who entered a TD at the same time as me but stopped paying and moved abroad. The letters they send are in joint names even though she has never stayed at my current address. They say I am the only way they can possibly get to her so are refusing to stop the letters and are now threatening to send a collection agent to my home. This has been going on for months and I keep sending the letters to KPMG and calling them - they keep saying they'll deal with it but nothing has changed in all of this time. If you get somewhere with resolving this it'd be good to know so I can follow the same path!

Before I went BR I had regular calls from collections agents.
I just 'forgot' my post code and other data protection information, if they started talking about the account I pointed out that they were breaking the law.
or
You can just say 'in writing only' and hang up

You could always consider complaining to the OFT or to their relevant trade body if they simply will not listen.

If you take this route can you let us know how you get on?

Disassociation isn't usually possible if there is a joint financial arrangement, however after your partner has been discharged from the trust deed there seems to be a good argument that financial disassociation could take place.

I doubt that it will stop the calls however as this just relates your his credit file. Using the identified complaints routes might be necessary if reasonable requests to cease contact have failed.
