Guardianship

My mum has had a very bad accident requiring Guardianship for both welfare and finance to be necessary. Family want me to share this responsibility with my sister. As I am in. TD I am unsure if I should, or indeed am allowed, to be involved with the financial aspect. Grateful for any advice.

I assume its guardianship as your mother is incapable of make the appointment under the normal Power of Attorney process.

You are unable to act in continuing POA if bankrupt or signed a trust deed, so I assume this would be the same for Guardianship orders. Strangely this does not appear to be the case for Welfare POA.

The Office of Public Guardian should be able to give you chapter & verse on this hopefully.

Yes, due to her accident my Mum has no capacity whatsoever and so Power of Attorney is not an option.

No problem, my wife went through the same thing with her Dad, so I spent a while going through the process and regulations.
