I'm 9 payments away from the end of a 42 month trust deed.

My landlord split with her partner and wanted our home back for her family to use so we were evicted. With three children and a need to stay in the area, we couldn't find a property and sought help from the Council. Council promised help but only if we stayed until the courts evicted us.

Due to the costs of the eviction and court costs my wages have been arrested (£1950 owed) to the tune of £433 a month! Our rent has increased from £650 to £1150 for the homeless property and I have accrued significant rent arrears with more money going out on bills alone than coming in.

Trust Deed company are refusing to let me go bankrupt saying they have to make me bankrupt. I'm not sleeping and really don't know what to do!

Hello MissK1988. I'm sorry you've had to wait for a reply - it sounds like you've had a really awful time through no fault of your own.

It's a fact that you cannot become bankrupt while you remain in a trust deed. Do you get the impression that your trustee will enable this for you soon by bringing the trust deed to an end?

Without your current trust deed payment, would your other bills and expenses be affordable?

It sounds like your circumstances have changed for reasons beyond your control. There should be some room for flexibility in these circumstances, especially as you have made so many payments already.

I would urge you to speak with your Trustee again and see what solution they can suggest. It may well be that you could still be successfully discharged from your trust deed and bankruptcy may not be necessary.
