Hi there, due to my payday loans I also stupidly took up online gambling as a desparate measure. My stakes heavily outweigh my winnings as outlined in my bank statements. As a consequence, I am in mortgage and council tax arrears but have always paid my trust deed. Can my trust deed company class the pay ins to my account from online gambling (of which there was not much I might add!)as profit owed to them even though it is clear to see that i have lost overall? As I think you have already identified, it sounds as though this situation is pretty much reaching breaking point.
It's really really important that you prioritise your mortgage and council tax due to the worrying ramifications if you get too far behind.
Don't worry about the occasional win being classed as income.
I think you probably need to speak with your insolvency practitioner directly and be honest about the situation that you are now in. Hopefully they can, one way or another, help you to find a way to deal with this.
Please please remember the priority that your mortgage and council tax should take over things like repaying payday loans. If the payday lenders don't get their money back in these circumstances I think it's the very least that they deserve.
Hi thanks for your response. I only have until August and then my Trust Deed is complete so must keep plugging away. Am I legally bound however to pay these payday lenders, and can they send debt collectors to my door even though, as you say, they have leant to me irresponsibly? I am so worried about these payday loans. Jo
Well, you've chosen to borrow from them so they're entitled to seek repayment from you josephine.
If you're in the latter stages of your trust deed perhaps you can contact the payday lenders to set up some kind of token payments for now with a view to full repayment once your trust deed ends?

Was there anything in particular that caused the payday loans to be taken and how much do you owe them?
As TDA says you must make sure the mortgage and council tax get paid.
