Hi all,
Since my last post looking for advice I have contacted my trust deed company who took a new income and expenditure from me.
I am a bit confused about something and wondered if anyone could shed any light on it? When going through my expenses, I told her my phone charges. She told me they wouldn't be counted as they weren't "essential". My confusion is because in my previous income/expenditure these cost were included. I also consider them essential as I care for my ill partner and must have a phone to contact her consultants etc. when required, therefore should they not allow me the expense?

Seems strange to me, I originally said I would give up my mobile contract when signing my TD but the IP told me to keep it as it was a reasonable cost.

Is the cost really expensive/indulgent or is it pretty competitive?

I would say it's competitive as I went for the cheapest I could find! I just don't understand why they would include it initially but won't let me do it now... almost seems as though they are cutting out what they can since my income decreased!

It does seem unfair to me but maybe when income drops they assess whats essential differently.

On paper it would make sense that they cut out some 'luxuries' when income drops to enable you to pay into the TD, but in your case I would hardly call that a luxury...

I am sure one of the experts on here will be along and let you know where you stand legally.

Hi.

I think most people would agree some level of phone expenditure is necessary.

Creditors certainly do, so it's not an easy position to understand.

My phone expenditure was the subject of some to-ing at protection time due to it being over the threshold a couple of my creditors were prepared to accept. They lump together the landline and mobile costs when deciding if it's reasonable. Eventually we reached an agreed figure.

Also, they were prepared to accept it would be higher because 2 of my children are if an age where they need a mobile for emergencies.

After they disallowed the phone expenditure was any "surplus" remaining that would allow you to make a payment into the trust deed?

I'm not sure why the phone expenditure would be disallowed if it was shown on the original paperwork. Out of curiosity how much is your phone expenditure?

Sorry for delay in getting back. I said my phone expenditure was ?รบ30 a month. Also, yes there would still have been some money left.

That figure of ?รบ30 is well within what creditors would normally consider to be reasonable.

How much surplus are they currently assessing?

How much was the trust deed payment before?
