Form 5, but no copy of original TD. Problem?

Looking to get all my creditors to fix their default dates on my account.

I have the Form 5, but they are requesting the original TD. I have moved house several times I seem to have misplaced it.

Typically I have all of the other letters from the Solicitors, even review forms...

Will it be a problem when I send my letter to the Data Control Officer/Credit Agency Teams at the banks?

Hi Scotslad.

I might be wrong and replying from memory, but does the Form 5 show the Trust Deed signing date and the date of discharge, with Trustee signature? I am fairly sure it did and I circled both dates when sending to the creditors.

You could always check that to see if it contains all you need.

I have also on occasion sent a screen snip of the TD entry on the Credit Reference Agency file too.

Have you considered calling you Trustee to ask for a copy of the original document if you are unsure about using the Form 5 only.

Good luck getting the records corrected

Might a printout of the Register of Insolvencies case history suffice?

It is of course something the bank could look up for themselves!

A quick call to your old Trustee and they may be able to,post you out a copy.

Thanks all for your replies.

I contacted my Trustee yesterday and as the TD was signed in 2009 and I was discharged in 2013 the paperwork has been "archived".

The Form 5 does indeed have details of the date I signed and the discharge date; however my concern is that when I send a letter to the lenders they will want evidence they were included in the original deed?

It's kind of irrelevant as all qualifying debts that existed when your trust deed began will be deemed to have been included.

I really hoped that would be the case. I found a template for a letter online yesterday and posted them out this morning.

I'm hoping they will sort out my file, I naively assumed they would update my credit file fairly.

In inspecting my file I noticed that one lender had recorded the default a full 26 months after the date of signing my TD. If I don't get it "sorted" then that'll still be on my file until December 2017.
