Failed trust deed total joke !

Where to start !!!

I posted months ago about how much of a joke Wilson Andrews are after the way my trust deed was going since I started it last October ! Anyway I still ain't made any payments as they left me with council tax to pay that I was told would be included and turned out it wasn't !! Had 3 months to pay £900 ! Didn't happen so I was then left to pay £900 plus £198 for this years council tax plus paying money on my trust deed !! Anyway I was signed off work for 3 months from March this year awaiting a knee op and was only on sick pay so couldn't afford to pay anything but my rent . Wilson Andrews have now told me they can't help me and my trust deed will be failed . In a way I'm glad as it's been a farce since day one but raging that my debts have just got bigger and left with an IVA on my credit report !! Like I said in the past the debts I had was mainly council tax from years back and the rest of the debts I could have managed by paying small payments but was told this was the best "way forward " as they like to quote so often !!
Anyway can anyone tell me will this be removed from my credit report now or will it stay on ??

It will show for 6 years from the start date I'm afraid.

It's a shame you've had a bad experience - sounds like circumstances have conspired against you. Do you have a plan for what you will do now?

Will it show as not active though ??? Plan is to contact all the creditors and arrange to repay with what I can afford

You'll show as having been discharged I'd have thought themolsshow.

As explained by Kevin, any entries related to the trust deed show drop off your credit report six years after it began.

I'm also sorry to hear that this choice didn't work out for you.

Hi themolsshow,

Sorry to hear that a Trust Deed hasn't worked out for you.

How much do you feel you can afford to pay per month towards your debts? Depending on how much you can afford to pay it could be the case that Sequestration (Bankruptcy) is one of the more suitable options to clear your debts within a reasonable timescale. Is this something that you have thought about or considered?

Can you advise how much your debt totals and if you have any assets.

David is not currently posting in the Trust-Deed.co.uk forum

I was thinking the same. Just because the trust Deed didn't work out for you doesn't mean that you should disregard sequestration too. How long is it likely to take you to clear your debts at the rate you can afford, themolsshow?

TurnDebtAround originally made a PPI claim against Bank of Scotland which then turned down a refund on two credit cards.TDA accepted this but I personally appealed to Bank of Scotland who after relooking at my appeal granted me a refund of £7,500 TurnDebtAround now are claiming 25% plus VAT fee for "the owrk they did on the appeal" but I now have a letter from Bank of Scotland stating that TDA had no involvement in this appeal. Where do I stand with TDA who are I believe falsely claiming a fee.

I'm not sure we're going to be able to help much on this one.

This seems to be a contractual issue between you and the firm concerned. As such I can only really advise you to seek legal advice if you intend to challenge whether a fee is due and payable.
