Hi, this is my first post.. my wife and i are in seperate trust deed accounts, because our debts were in joint names, however my wife may get a payment from her work soon, will that get taken by my TD provider, to pay what she owes or does it affect both our accounts? And what happens to the monies already paid by her. Many thanks and i hope these question are easy to understand.

Depending on what the payment is for, the trustee may take some or all of it. This would be paid to your wife's trust deed, not yours. The only real effect may be a higher dividend from your wife's trust deed.

Hope this makes sense. If you advise what the payment is for, hopefully we can advise further.

Hello poprey.

You'll probably need to confirm with the trustee whether all or some of that extra income will have to be paid over. I think you can expect that at least a proportion will have to be paid, and possibly all of it depending upon what was agreed at the start. It's a question only the trustee can answer for sure.

Please ask further questions in this thread if you wish, or start another if the topic is totally different. It doesn't really matter.

Hi,With reference to my last question on extra payment from my wives employer, if my wife owes an amount of the debt, say £10000, and she is payed £12000, would that mean she would pay the £10000 and keep the rest, and then would she be discharged from the trust deed, and any income she has would not be used against me.
i have just finished my first year, so i received a pack to fill in and send back, i was unclear what to do, so i called my TD provider and asked what to do, they said only send it back if there is a significant change to my circumstances, i am not sure if this is the correct information, is this normal. Thank you.

Hi poprey.

The most that your wife will have to pay, including what she has already paid, is:

1 - The total amount of the debts. This includes the full amount of joint debts.
2 - Interest on the debts.
3 - The fees and costs of the trust deed.

That's likely to come to a lot more than £10,000 I'm afraid.

I think I'd respond to the review whether or not anything has changed. It seems to me that's likely to help avoid confusion later.

I am just using these figures as an example, am saying once she jas paid what she owes, if there is anything left will it be used against my account, Thank you.

No, your wife is responsible for her debts and your joint debts. If there's a surplus, per the previous calculation, that will be returned to her.
