my ex partner is suing me in court for a capital sum he thinks he is entitled to for looking after the children when they were small. I am skint and have just recently signed a trust deed. His lawyer has been in contact with my trustee saying he wants my ex's claim registered - even tho no award has been granted to him and as far as i was concerned he did not count as a creditor. This court case has been pending for over four years during which time I have tried to pay off the debts until finally admitting defeat and signing the TD. Can anyone shed any light on my position - thanks.

It would be for the trustee to accept or reject any claim, however without decree I think it's unlikely any trustee would accept it.

Whatever happens the trust deed would protect you from it.

thanks Mark - would that still be the case even tho my trust deed s not yet protected? I'm worried his latest actions will stop my TD reaching protected status.

You'll be protected if/when the trust deed becomes protected.
