My husbands trustee has agreed that we can settle early (payment offered from 3rd party) we have been advised to send letter from 3rd party, proof of funds and payment. This is all ok. So I've asked for confirmation that my husband will be done and that's it's settled. They have replied saying "your husbands legal obligation will have been settled but he will not be discharged for several months"
Please can someone explain? Advise why? Or give me response for them. I don't get it, I thought it was pretty immediate and we would receive the discharge form?

I think you just ask them why it will need to take that long.
If everything has been completed there should be no reason why he cannot be discharged.
In terms of settlements some trustees will cease collecting contributions from income, but not discharge their client until later (perhaps the expected end date of the trust deed). This is so that creditors could still benefit as originally agreed if your husband came into money later somehow.
It might just be the trustee covering themselves in case they get busy though.
Thanks. We have already paid the equity in the house. There is seriously no chance of him getting money. We don't gamble and he isn't getting any inheritance of any sort. We thought that...it gets paid early. He's discharged and we are free to get on with our lives. It's only been 15 months but it's been stressful.
Keeping him in it until OCT 2015 would seem silly and pointless someone paying it off for us in the first place no? We have nothing to hide but just thought it would be behind us ๐
I replied asking them to elaborate/explain to me. I think the guys getting annoyed. I have also asked when we can expect the form 5 after the payment has cleared. It's just killed the excitement for us a bit. Thank you
As you say, there is really very little point in paying a lump sum if it doesn't mean an early discharge and Form 5 can be done every quickly so I don't see why it should take them several months.
