Wondered if anyone can advise on early discharge due to ill health.

My TD is due to end in September 2014, I am self employed and took ill in May last year and have been advised to give up work as now in my 60's.
I had a PPI Redress of £15000 and asked if there would be any possibility of an early discharge, the expected amount to be ingathered at time of signing was £13000 but my circumstances improved so contributions went up by over £200 didnt mind as I was coping till I had a heart attack which has made life difficult but thought that with the extra paid I may be discharged but apparently not I have to continue till Sept have tried explaining my health is suffering . My partner is 71 really worried about the next 6 months

Welcome to the forum countrylass. I'm sorry to hear that you're having such a hard time with your health at the moment - it must be very worrying.

The PPI redress is a separate factor to your income-based contributions. That would generally be in addition to, rather than in replacement of, your assessed monthly contributions.

However, the fact that you're nearing the end of your contributions and that the "pot" has been swelled by this large amount of PPI money may well encourage your trustee to take a sympathetic view of your current circumstances.

I think you should contact your trustee to explain the current position, supply them with evidence that you have received medical advice to cease working, and request that your trustee consider granting you your discharge from the trust deed and your debts at this time.

They're the decision maker countrylass, so no harm in going straight to the top.

I'd be tempted to write to my trustee personally, with the evidence mentioned previously, to be sure that they review your case.

Hi countrylass,

Do you have any assets that are part of the Trust Deed i.e. your house or an expensive motor vehicle?

As TDA suggests, I'd send in a letter directly to your Trustee to make them aware of your change in circumstances and also the problems with your health. If you don't hear back within a couple of weeks then chase them up again for a response.

If your Trustee has ingathered the PPI money and you are able to provide evidence to support that you are having to give up work due to I'll health then I'd like to think the Trustee will be understanding and agreed to close your case.

I'm not sure whether your trustee will agree to discharge you early, countrylass, but at least they may be open to allowing a reduction in your contributions (perhaps down to nil) if you can show evidence that you should not be continuing to work due to your health.
