Hi
Could you tell me what is the normal 'procedure' when a debtor is discharged from trust deed.
My husband was discharged Nov 2016 and the trustee was discharged Dec 2016 (both according to ROI register) but my husband does not believe he received any certificate or anything to say he is now discharged.
Should he have received something like this? The Trust Deed was with Invocas if that is relevant.
Am I right in thinking that now he is discharged they cannot now take anything from us? For example if in the next few years we were to manage to buy a house, would they have claim to that?
Is he completely free from it is what I'm asking really?
Hi daisychain
He should have received a "Form 5" in the post at the time, which is basically the proof of his discharge.
That's correct, the Trust Deed only deals with assets and income that existed prior to discharge. Anything else is entirely yours/your husband's and there is no danger of this being taken away.
Thank you. Do you know if we contact invocas would they send us another form 5?
