Good afternoon,

I hope some of the experts on here can help me.

I started my trust deed in September 2008. It was to be paid 4 weekly with 39 payments in total. I was told that my payments would be 237.00 and i was given giro slips so i could pay my payment into their account while the TD was getting set up. I made two payments of £237 then my TD became protected.

A direct debit was then set up with them over the phone and i was told that my contributions would be lowered to 184.62 (i assumed because i was paying 4 weekly)

On the 9th of September 2011 i made my 39th payment to my TD. I called up my trustee to ask what was next. A bit of confusion on the phone as my trustee thought my TD was due to end in November 2011. I explained i had made my contractual payments as on the 9th Sept and he agreed and said a final review needed to be complete. I sent off my wage slips and bank statements as requested.

Four weeks later i had a voice mail from my trustee telling me i had arrears as i earned more due to night shift premiums on the odd month here and there and my trust deed would be extended for 2 months.

As i canceled my direct debit i sent a cheque for £369.24 to cover my arrears.

January came and the money had still not been taken from my account so i called them to ask what was happening. I was told they never received my payments so i said i would pay the £369.24 over the phone by card. I asked my trustee if that was me done and he replied yes you will be getting a letter through the door soon.

Another four weeks past and nothing, and with knowing that a form 5 of discharge can be easy to send i phoned my trustee asking what was the hold up. I was informed that a review was being done and if i had no arrears my account would be passed to the closure department.

Today i received a letter informing me that i had made 36 monthly contributions and that my TD would be extended for 4 months at £246 a month due to arrears totaling 859.90.

I'm confused as i have paid in total 41 monthly contributions to date as i explained to my trustee on the phone a few days ago.

Im very stressed as i thought i had completed my TD obligations i booked my first family holiday and with the thought of having to pay more i will loose my holiday.

I hope someone can help me see what is going on before i call my trustee again.

Hello BigEck.

Sorry you've had to wait a while for a response to your question, it looks like everyone has been out and about this afternoon.

I think you need to request a copy of the information that they hold on the payments you have made. You'll want to reconcile their records with yours and point out any disparities if they exist. It isn't impossible that there is an admin error somewhere. They should easily be able to provide you with this information.

Secondly I think you need to confirm that your first two payments went into your trust deed rather than being some kind of upfront fee that was paid either to your trust deed firm themselves, or an intermediary firm that then passed you to your trust deed firm.

Thanks for your reply TDA

If i call my trustee tomorrow and ask him how much my contributions total to date are, is this something he could work out and tell me over the phone?

I was not aware of any fees to be paid at the start. I was not referred to this company, i went direct to them myself. According to their web site there is no up front fees nor is there any mention of this in my documents.

Also i have been looking through my paper work, i think it may be a copy of the TD document itself and it lists a total of my debts. However my reviews have £2,500 over what is stated in the documents i signed when entering my TD - is this normal?

I think trust deed assistant's suggestion to ask for a breakdown is a good one. I wouldn't be at all surprised if those first 2 payments you made don't appear!

Regarding the debt totals, maybe you had underestimated the balances owing and this was subsequently amended following claims from creditors?
