I received a form 6 today I see on here that alot are talking about form 5 should I receive this also?

Hi emma99.

If Form 6 has been issued the Form 5 will also have been previously.

Ask your former trustee for a copy if it's something you'd like to have.

As TDA says, Form 6 is issued after form 5. Form 6 is the Trustee seeking his discharge.

You should check the AIB website to check you have been discharged and request a copy of Form 5.

Not particularly, but it may be handy to have to pass to creditors etc to update credit file. The main this i suppose is to double check that you have been formally discharged.

Just phoned trustee not in till monday. What I need to next once I get form 5?

Nothing as that's really your part finished. Because you have received Form 6, it would suggest that the trustee has completed the administration of the case and this should be finalised shortly.

I may be a touch thick here ,however,was so preoccupied with form 5 never really thought about form 6. Have recieved form 5 and discharged on insolvency register..should I have recieved form 6 by now?recieved form 5 roughly begining sept..

Hi cal.

It can take a while for your trustee to discharge themselves.

It doesn't make much (if any) difference to you though.

I phoned trustee today said I did not need form 5 they would be sending it to the creditors. Is this right?

Hi emma99.

Most firms seem to send a copy to their client.

You can verify your discharge on the online Register of Insolvencies though.

Sorry but the response from the Trustee's office is wrong. It is a requirement for the Trustee to send you Form 5 and a copy of this to the AIB's office. On receipt, the AIB then updates the details in the Register of Insolvencies.

Why not write to your trustee, personally, requesting that they send you a copy of this document?

As mentioned earlier, i don't think having the actual form makes any difference, however you need to be sure it has been sent to the AIB and they have updated the Register of Insolvencies. If they have not sent you a copy ( which they are required to do) or think that they do not need to send you one, then I'd question them sending it to the AIB!
