Hi
I've been going through my credit report and noticed that I still have accounts which were included in the Trust Deed showing as open and have been defaulting all this time even though I was discharged back in 2014. One of the accounts is for Barclaycard and the other is for a company I've had no dealing with and never had credit with, they are called Pco Holdco Sarl C/O Watch Portfolio Management. With this second one I've done a bit of digging and seen that they could possibly bought my debt at some point. Just wondering if anyone has had dealing with either in regards to changing the default notice and what's the best way to contact them. Many Thanks

I had the same thing happen to me with a company called Cabot Financial, who had bought over a debt I had with RBS. I received letters from them asking for payment which I passed on to my trustee and he dealt with that so letters stopped. On being discharged and on checking my credit reports I noticed that I had two accounts still showing default. Cabot Finance and Clydesdale Bank. I wrote to them both in July asking for credit report info to be updated to show I had been discharged, sending them copies of Form 5 and Extract from Insolvencies Register. Nothing happened, so I wrote again sending letters recorded delivery this time with a cover note and again copies of Form 5 etc. Within a few weeks I got an email back from Cabot apologising that my original letter had been dealt with incorrectly and they have now updated the information that the credit agencies have on me. I wish the same could be said of Clydesdale Bank because despite the two letters and many, many phone calls being passed from pillar to post, they have not responded at all. I have now completed an official complaints form with Clydesdale Bank and they now have eight weeks to deal with my complaint and get back to me. On advice from this forum I will be taking this to Ombudsman next.
So in short, write to these companies and send all paperwork showing your discharge from PTD and be persistant, sending recorded delivrey is recommended. Hopefully they will do what they are asked as they

Thanks for the reply Lesley. I've taken your advice and I've sent a letter recorded delivery with a copy of my form 5 to both companies so I'll just have to wait and see. I managed to speak to Barclaycard over the phone and they said that the debt would be removed automatically 6 years after the signing of the trust deed, but I'm not happy to wait for this and think its only right they show an accurate record of the current status of the account. If nothing is done by either company I'll be following the same path as you and contacting Ombudsman.

I hope you hear back soon now you have sent letters. To update on my own situation as I had still not heard back from Clydesdale Bank I went on to their own website and filled in their online complaints form explaining how may times I had written to them and phoned them, but had no replies. On their website they state that they should reply within four days to any complaint and aim to have them resolved within the eight weeks. Lo and behold yesterday,on day four, I got a call from Clydesdale Bank replying to my complaint and I now have someone investigating my case, so hopefully this will be resolved soon. So if your letters don't work maybe try their official complaints site too. Good luck.

Just a quick update to this. I contacted both creditors and after a couple of weeks, received letters from both stating that they would change the accounts to partially settled and pass on the info to the credit report companies, so I'm just waiting now for it to update and will be interesting how it will affect my credit score.

I'm glad to hear this has worked out Headwire.

A shame that these efforts are needed, but they do seem to work with a bit of effort and persistence.

you should make the complaint to the Information Commissioner's Office rather than the Ombudsman as it is a breach of the Data Protection Act where the data controller is responsible for ensuring that they information that they provide about you is accurate and fair.

I wouldn't necessarily agree with that pingpong.

If I were only going to raise this issue with one body, it would be with the Financial Ombudsman.

There is a good argument (which you have made) for raising it with the Information Commissioner as well though, if people want to make that additional effort.

Thanks for your replies. I had contacted the Information Commissioner's Office and they advised me to resend all documents recorded delivery, which I did. That's why the next step would be the Ombudsman.
In the meantime I have now heard back from Clydesdale bank and they have asked me to send over my discharge information again (third time lucky), I emailed them to the person who has been assigned my complaint,so hopefully this issued will be resolved soon with no need to contact anyone! Fingers crossed.

That sounds positive Lesley.

The people who work in complaints departments are usually empowered to deal with things like this pretty quickly and efficiently.
