defaulted on a protected trust deed

Hi there

I entered into a protected trust deed back in 2004 and stupidly ended up defaulting on it (stopped paying into it basically) I let the company know who set it up for me that I was moving abroad in 2005

I then moved to England in 2007 (where I still reside) and heard nothing. Even my credit file had nothing on it which I last checked in 2008. Ive been able to open a bank account and I'm close to completion for a mortgage with my fiance.

Now out of the blue I recieved a letter from a debt collector Rockwell who are working on behalf of their client Tessera Portfolio Management and the original lender being Intelligent Finance a demand for ?รบ6300 Which I am sure was part of the original Trust Deed.

Does anyone have any advice on this and if I should send off a 'prove it' letter or should I ignore there demand?

Is it possible I have been sequestrated and if so how can I find out?

Any advice would be very grateful

There appear to be a few things that might have happened when you stopped paying your Trust Deed.

Hi

it's difficult to tell on the current information. You could check the Edinburgh gazette online to check if the trust deed had been converted to a sequestration. If not, it may be that you are still in it!

Hi There

Thankyou both for replying to my post.

I have checked the Edinburgh Gazette and it only has me down as been granted a trust deed on 2nd of March 2004.. no mention of sequestration.
Like you mention Mark, if I am still in it, how would I find out so? Is it possible I can continue or attempt to restart payments back into it?

Also, if I am still in the trust deed would it not be illegal for debt collectors to send me threatening letters?

Hi

the only way to get a definite answer is by contacting your Trustee or possibly The Accountant in Bankruptcy to see the the Trust Deed is still 'live'

it is difficult to comment on the creditor action without knowing if the Trust Deed is protected and if it is still live.
