Hi,

I entered in to a protected trust deed in 2010 and was discharged in 2013. I have since spent the time updating all accounts with the relevant credit reference agencies.

Today i have just noticed that a company TTI SPc have added a default dated in April 2010 which i think may be a loan from Black Horse. Should they be able to do this? I am currently going through a mortgage application and this is the last thing i need.

I will contact them tomorrow but just hoping someone on here will have had experience in this.

Thanks

Welcome to the forum Colinr1983.

The sale of debts which are included in trust deeds is pretty common.

The firm that you mention has been referenced here a number of times in connection to Lloyds/Blackhorse. See the following thread for example:

I'm not sure it's possible to sell a debt without first issuing a default notice.

Certainly your creditors are entitled to register a default notice on debts which are included in your trust deed. It shouldn't be dated much after the date your trust deed began.

Once you have been discharged that default notice should be marked as being satisfied or partially satisfied.

Sorry that I cannot give you better news.

A default notice is a one-off matter of record and as such I guess they are entitled to reflect that on your credit file.

However, if the entry suggests that there is a balance owing then that is incorrect if you were successfully discharged from your Trust Deed, so they should have to amend that if you contact them.
