Can anyone give advice on the following; I completed my PTD a year ago and was sent a letter of discharge from my trustee. Everything seemed fine. I have recently been getting letters from a debt recovery agency stating that I owe money to a former creditor which I know was included in my PTD, although the amount they are asking for appears to be approx ยฃ400 higher than that on my original PTD paperwork. I have replied in writing to this recovery agency clarifying my circumstances and also giving them a copy of my discharge letter with my former trustees contact details for them to verify my reply.
This has not had any effect and I am still getting letters of intent to act from them. It also appears that this debt recovery agency has had my details passed to them by another.
I am getting concerned now due to the frequency of the letters I am getting and thier intention to act.
I am 100% certain I owe them nothing.
Can anyone give advice or guidance on this matter.
Thanks

You have done all you have to do by forwarding them your discharge letter,if they have bought a debt which was covered by your TD then tough luck on them. Is the debt listed on any credit files as still outstanding?

Hi mat.

Given your description, there is no debt.

If the keep contacting you I'd advise you to make a formal complaint to them. Hopefully someone sensible at their end will then take care of this for you.

Hello mat

The debt recovery company has no ground to chase you for a debt that was previously cleared/written off through a completed trust deed because legally it is no longer a debt.

So you really have nothing to worry about, from the sounds of it you have informed them of all the relevant information they need. If they are persistent I would write a strongly worded complaint letter to them again with another copy of your discharge letter. They cannot take action against you, they can't hound you for something that no longer exists and even if they did and tried to take it to court, no court would entertain it on production of the information that it was cleared through your trust deed. So not only would it be embarrassing for the company but they would be wasting their own money on court fee's not yours.

So don't lose sleep over it. It's not uncommon or older debt to be sold onto other companies and the new companies sending letter and making phone calls as they are not aware the debt has cleared or written off.

Lou
