DEBT COLLECTORS AFTER TD COMPLETION

I was discharged from my trust deed in December 2012. I have not taken out any debt since the completion of the trust deed and neither do I intend borrowing any money from anyone again. However I received a message on my voicemail today from Scotcall asking me to contact them. They are obviously trying to recover some of the debt covered by the trust deed and may not be aware of the existence of it. What should I do now, should I ignore the calls? would appreciate some help with this.

More often than not they will be chancing it. Probably best to advise them of the trust deed and refer them to the Edinburgh gazette or register of insolvencies as confirmation.

Once the Trustee has been discharged he has no authority to discuss the matter with Scotcall. As Mark suggests, refer them to the Register of Insolvencies.

Generally though, unless there is something in it for them they won't take pro-active action such as that, so sending them a copy of your discharge may help.

I think they are just chancing it! I wouldn't ignore it as it will just continue, best to be proactive and deal with it head on.

You'll probably find that the person you speak with at Scotcall won't spend the time to look at the register of insolvencies or Edinburgh Gazette. Their main objective will be to collect what money they can from people and after the call with you they will probably move down the list to the next person to call as they can't get any money from you.

As Voice of Reason suggests send them a copy of your discharge certificate. If you can, post this to them and also email a copy if you are able to. If your Trustee is still in office and hasn't been discharged then advise your relationship manager/Trustee about Scotcall and let them deal with it for you.

How did you find the whole process of the Trust Deed JTM21? I'm always interested in hearing feedback from people who have been through the process.

Unfortunately you will probably enter Call Centre world, so it may take a bit of time before someone actually takes the initiative and updates their system.

These things have infrequently and as stated, if the Trustee has been discharged they will probably not have anything further to do with it, although we normally forawrd a copy of the Trust Deed or other docs whether discharged or not.

To answer your question David, my experience with the trust deed was a positive one. It obviously helped me get back on my feet financially and I wish I had plucked up the courage to do do it earlier. Regarding Scotcall, I did call them and explained about the trust deed but the guy I spoke to said they would need a court reference number?? which I can't find ammongst all my trust deed documentation. If they call back I will offer to send them a copy of my discharge letter as you and others have suggested. If this doesn't work is there anything else I can do? By the way the amount they are chasing me for is only ยฃ54.

You'll struggle to find a court number. A copy of your discharge should suffice, though they could probably just look it up online if they wanted to.

There are no court reference numbers in Trust Deeds, probably the closest thing is the AIB reference.

A copy of Form 5 and Edinburgh Gazette notice should hopefully be sufficient. If they continue, advise that the debt was included in the trust deed and their continued calls are harassment.
