Good afternoon,
I am looking for some advice in relation to sending off CCA requests to creditors who are currently in a DAS. The purpose of this is I would like to know exactly where I stand with each creditor should something ever happen to my DAS for whatever reason. I know it is my right to request copies of the CCA agreements however do you see any problems with me doing this whilst in a DAS? Would this breach any of the DAS terms and conditions or would it cause any unforeseen issues?
Thanks
Yes, that would be the purpose. I would discuss first with MA before even attempting this.
I am in a Das once your Das is approved you are protected from your creditors they cannot ask you for extra payments or send letters saying they are taking legal action it's the law
I don't see how it could cause any problems for you at all DASdude. As you say, it is your right to request these documents - creditors cannot revoke your DAS just because you have exercised your legal rights.
Thanks everyone
You can put in all the CCA requests you want while you're in a DAS. No problem.
If you want to use the results of those requests to negotiate a settlement amount it gets more complicated.
If you are in that position, or are hoping to be in that position, you should probably have a chat with your money adviser to see how to deal with it without breaking your DAS commitments.
Thanks Candlewick - happy new year to you! ๐
