I have fairly recently entered a PTD which has been a massive help to me. I had from the first time I contacted my IP firm kept my creditors informed of my actions re applying for a PTD and answered all their calls. This was stressful as I was continually explaining the same things time and again to them. I had hoped that once my PTD was registered I could tell them this and refer them to the website so they could check this themselves, I would add that they all refused to contact the IP they said for data protection reasons they could not do so. I find it difficult to understand this as they were happy that I had correctly identified myself to them and I authorised them to contact my IP but they refused. The worst ones I have dealt with are GE Money and Barclaycard joined today by Mercers chasing for Barclaycard. In my conversation today I explained to them re PTD told them about the AIB website to check, gave them IP details and references and they said could check this but would only hold calls for 7 days as they/Barclaycard had received nothing from my IP. So basically I have told them I am in a PTD which they said they understood yet still they say will chase me until they have received something from my IP. This seems crazy they have the information available, I have authorised them to contact my IP but no they have to be contacted and undoubtedly they will say they have received no contact from IP when I know it will have been sent. You cant seem to get through to them that you have dealt with your debt problems as best you can, you are in a PTD and can do no more yet still they insist on calling you, 8.00 in the morning or 8.45 at night are good for them or GE Money are quite fond of first thing in the morning then 2 hourly intervals. Why when my IP has carried out their part do they have to keep sending things again just because the firms internal communications are pathetic, surely it is not rocket science for them to think to check with whichever department/outside agency deals with this type of matter to confirm things and update their records. I have asked my IP to contact Barclaycard for me again on my behalf. Sorry for rant its just so frustrating to still be going through this and I am sure the IP's will find it equally time consuming and frustrating. I am going to write to Barclaycard and Mercers to request all future contact is in writing which I think I am allowed to do as I have just had enough of them now.
oops should have said despite the frustration in still dealing with creditors calls going for a PTD is still the best thing I did and it is a million times better than the constant worry of trying to deal with my debt myself.
One suggestion is change your phone number. That'll reduce some of the stress. I ended up switching off the ringer and ignoring the phone. If they can't get a hold of you, they'll write telling you they'll send debt collectors. They have no right of entry so don't entertain them. I had loads of cards from Mercers - they are persistent. Keep sending everything to your trustee. It'll last for 6 months or so then go quiet.
Nothing left to discharge - everything's done and dusted!
Hi Worriedmary, yes it is very annoying and you can do no more than you have done already. You are not responsible for informing your creditors of your PTD and your IP will have contacted all your creditors. When my TD started I told every creditor that phoned I stated I was in a PTD and that I would not speak to them, I advised them to contact my IP and hung up. If they rang again I stated the above then went on to advise them that this was now harrasment. My phone calls ended in a week. I was short, sharp and to the point. I never entered into a conversation with them I said what I needed to say and hung up. Any letters I just forwarded on to the IP. The letters took a couple of weeks to stop. Hope this helps.
Changing your phone number is free with BT if you explain you are being harassed throughout the day every day. You will get more letters but stop the calls which are more disruptive.
Lets be clear on this, your IP will have communicated with every single one of these creditors as part of setting up the trust deed.
There is no reason why anyone should put up with hassle because internal departments within major financial institutions fail to communicate with each other.
If you've made reasonable attempts to point them in the right direction, and they've failed to respond, you may wish to make formal complaints so that someone with some sense and authority can look into it from their end.
Presumably they'd want to do that as they're wasting a whole lot of their time and money repeatedly contacting you.
I would suggest you take the name and number of the person calling and ask your trustee to call them directly. Usually this can be sorted with a fax directly to a named person at the relevant department. Unfortunately, letters seem to often get lost in the abyss!
hi many thanks for all your comments had a bit of progress today as I had mentioned the complaint word in my conversation with Mercers they logged it as one and passed it to Barclaycard. Credit where it is due Barclaycard relations member called me today to explain there point of view and allowed me to express mine, at the end of the conversation they agreed to contact my IP to obtain the info as they were unable to do anything until they had the info from the IP. I also obtained a fax number and an address and have advised my IP accordingly who at least now has a contact point. Hopefully, this will sort things out just seems a shame that so much time and effort is wasted to get to this point but at least at the end I felt I was dealing with a person who treated me as a person and was not totally tied to a script on how to deal with people in my situation.
